UbeSIM iOS App Terms of Service
These Terms of Service ("Terms") govern your use of the UbeSIM native iOS application (the "App") operated by UBESIM ("UbeSIM," "we," "us," or "our").
These Terms apply only to the iOS App. Purchases and browsing on ubesim.com are governed by the website terms at ubesim.com/terms.html.
1. Acceptance
By downloading, installing, or using the App, you agree to these Terms and the UbeSIM iOS App Privacy Policy (available in Account in the App). If you do not agree, do not use the App.
2. The Service
The App lets you browse prepaid travel eSIM data plans, purchase plans, view order history, manage active eSIMs, apply promo codes, install eSIM profiles on a compatible iPhone, and optionally receive service alerts. If you sign in with Apple, you may also use cloud backup and restore for your My eSIMs purchase list.
eSIM availability, speeds, and coverage depend on your device, destination networks, and plan terms from the underlying mobile operator. We do not guarantee uninterrupted service in all locations.
3. Eligibility
You must be at least 18 years old (or the age of majority where you live) to purchase through the App. You are responsible for ensuring your iPhone supports eSIM and is carrier-unlocked where required.
4. Account, Guest Use, and Restore
- Sign in with Apple is optional. You may browse and purchase as a guest.
- You may enter an email at checkout to link purchases to My eSIMs on your device.
- Device-local list: My eSIMs is stored on the device. Uninstalling the App or clearing App data removes the on-device list even if your eSIM profile still works on the iPhone.
- Cloud restore: Only available after Sign in with Apple. We verify an Apple identity token on our servers. Email alone is not enough to restore purchases. Use the same Apple ID that was signed in when the backup was created.
- Guest purchases: Are not restored from the cloud. Sign in if you want purchases linked for restore after reinstall.
- We may remove expired or validity-ended plans from the cloud backup only; that does not cancel or uninstall an eSIM already on your device.
- You are responsible for the accuracy of your email and for keeping your device and Apple ID secure.
5. Purchases and Payment
- Prices are shown in USD before you confirm payment.
- Payments are processed by Stripe. Apple Pay is supported where available.
- Promo codes are subject to availability, expiry, and plan minimums shown at checkout.
- When you complete payment, you authorize us and our partners to provision the selected eSIM plan.
6. Delivery and Activation
- After a successful purchase, your eSIM details appear in the App (My eSIMs).
- You are responsible for installing and activating the eSIM on a compatible device.
- Data plans typically activate on first network use or according to the plan description shown in the App.
- Install links may open in Safari or the system eSIM installer.
7. Refunds and Cancellations
Because eSIMs are digital goods that can be activated quickly, refunds are limited. Contact Global@UbeSIM.com if you have a billing or provisioning issue. We will review requests case by case and according to applicable law and eSIM provider rules.
8. Acceptable Use
You agree not to:
- Use the App for unlawful purposes
- Attempt to reverse engineer, abuse, or overload our systems
- Resell or redistribute plans except as expressly permitted
- Provide false information at checkout or support
- Attempt to access another person's purchase catalog or restore data without authorization
9. Third-Party Services
The App relies on third parties including Apple (Sign in with Apple, Apple Pay, push notifications), Stripe (payments), eSIM Access (eSIM provisioning), and Cloudflare (infrastructure, including catalog backup/restore APIs). Your use of those services may be subject to their terms and policies.
10. Disclaimers
THE APP AND eSIM SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CLOUD BACKUP AND RESTORE ARE PROVIDED ON A BEST-EFFORT BASIS AND MAY BE UNAVAILABLE, INCOMPLETE, OR DELAYED.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UbeSIM CORPORATION WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR eSIM SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PLAN GIVING RISE TO THE CLAIM IN THE 30 DAYS BEFORE THE CLAIM.
12. Termination
You may stop using the App at any time. You may delete account data stored on your device from Account → Delete Account (and, when signed in, request deletion of your cloud purchase catalog backup). We may suspend or terminate access if you violate these Terms or if required for security or legal reasons.
13. Changes
We may update these Terms from time to time. Continued use of the App after the "Last updated" date changes constitutes acceptance of the updated Terms. An updated copy may also be published at https://ubesim.com/ios-terms.html for reference outside the App.
14. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules, except where consumer protection laws in your country require otherwise.
15. Controlling language
These documents are provided in multiple languages for convenience. If there is any conflict or inconsistency between a translation and the English version, the English version controls.
